Terms Of Service
Paying for a commission acknowledges that you have read, understood and agreed to my Terms of Service. If you have any questions about the terms, notify me before any payment is made and/or the commission is accepted.

1. Commissioning.
In order to commission me, you must completely fill out a Commission Order Form to the best of your abilities. Anything else will be considered an inquiry and not a commission request. If you have any questions, feel free to add them. If I accept the commission, we can talk about details and confirm price.
2. References.
All references (images or written references) must be received before I start working on your commission. I will inform you when I start and will ask for any last details so you have plenty of time to tell me if you'd like any specific details or poses in mind. Image references preferred but written references are accepted. I will ask for extra information if I do not understand or just require more information. Anything not given is an understanding that I get to use artistic liberty to draw as I see fit.
3. Time Frames and Deadlines.
Depending on style/type I can take anywhere from a week to a few months to complete art once I start. If you need something before then or do not like my time frame then do not order. If I am going to be gone for any extended period of time I will notify you when you order and if anything comes up or changes after I start I will notify you and we can talk about it from there.
I do accept deadlines within reason. If you have a certain time you would like it done by add it into the order form and I will let you know if I can make it or not. If something comes up and I am not able to make it I will notify you as soon as possible and we can talk about if you would like me to continue or not. Rush fees may be added.
4. Change Requests and Progress Reports.
I will send WIPs (Work In Progress) with each stage and ask if any changes are needed. Once you have ok'd a stage, any changes that are not very minor changes or tweaks will not be accepted, so please request any changes before I move forward. The stages are Rough Sketch: A messy sketch to basically show the general pose/vague details. Not all details are added in this stage. Sometimes I skip this stage if a pose was already suggested/agreed upon. If any changes are requested I will fix them and resend until approval is expressed. Next stage is Lineart: Pretty self explanatory. The lines will be drawn and most or all details added. If any changes are requested I will fix them and resend until approval is expressed. This is the longest and hardest part of the art and with all that time and effort put in it's not right for me to be losing compensation. Next stage is Base Colors AKA Flats: Also self explanatory. Base colors. I will more than likely skip sending a WIP of this stage because it is so minuscule. And last stage is Rendering and Finishing Touches: This is where I shade and add any little extra elements. If any changes are requested I will fix them and resend until approval is expressed.
You can also request to see progress at any time, just send me an email. But please don't spam me with progress requests.
5. Streaming and Video.
I will do livestreams if requested. Or if you'd rather I not livestream it at all I will comply with that as well. I also sometimes record my drawing and upload it to YouTube. So please express any concerns with this before I start the art. If you wish to watch the streams, let me know what times you are available and I will try to correspond schedules. But please note this will prolong the time it takes to finish your commission. If you have to see it being done and our schedules don't line up for a week, that's an extra week I can't work on it.
6. Completed Commission.
Once I have completed the commission, and you have ok'd it, if you sent half the payment upfront, I will send a small, watermarked version of your commission to you and request the other half of the payment be sent. Once full payment is received, I will send the larger unwatermarked version. If you sent full payment upfront, you will receive full, unwatermarked version right away. If you would like a different size, request it and I will be more than happy to send you a re-sized version.
7. Lost Communication.
I have all the places you can find me listed in my "Links" page on my website and will always respond to Emails, though sometimes I am a little slow to respond. I do try to check them at least once a day. If I do not have communication from a customer for over 3 months and I have made multiple attempts to contact you with no reply, I will assume the Commission is terminated and remove your request, forfeiting any work I have done and any payment you have sent to me. You will NOT receive refunds or any art that I may have done after the 3 months has gone by with no reply from you. Please let me know of any extended period of time that you know you will be unable to have contact for, ie. vacation, moving, lack of internet, ect.
8. Prices.
Prices are NOT NEGOTIABLE. Do NOT try to haggle or guilt me into lowering the prices. I price things as I deem fit. Things that take more time are worth more money. If you do not like the prices or cannot afford them, do not request a commission.
9. Payment.
I accept PAYPAL ONLY. I accept US DOLLARS (USD) ONLY. I will not accept hard cash, checks, Credit Cards, Virtual Currency, or any other form of payment other than PayPal. I will send you an invoice for the agreed upon amount and you will pay it ASAP. I WILL NOT start on your commission until I have received the payment.
Anything under $40 I require full payment upfront.
If no payment is sent, I will reserve the customer a spot on my list of active commissions for 10 days. After that, I will remove the request from the list and you must resubmit it. You will not be put back into the queue where you were before I removed the request, if you resubmit the commission; you lose that spot should your request be removed after the 10 days of inactivity.
10. Discounts.
Return customer discount not applicable to YCH (Your Character Here), Adoptables, auctions, or emote bundles.
11. Refunds.
Because of paypal fees and my time, If you need a refund please discuss it with me. Once I've started working on your piece I cannot give back a full refund.
12. My Art Style.
My art style is my art style. I draw how I wish. I will not draw in someone else's style. I like to learn and improve my art but do not critique my work unless I explicitly ask for it.
13. I will not draw:
Mecha/Full Armor, Old People, and Some Fetishes. I am willing to try anything once I say but if I feel I cannot do it then I cannot do it. I am ok with drawing a few armor pieces but not mecha suits or mechanical beings. I do do NSFW art but there are some fetishes I will not draw. When in doubt ASK ME. You can ask me if I think I can draw it and I will let you know if I think I can handle it, I won't get upset.
14. Image Rights.
Copyright/Usage Policy
I, Krista Pearson (aka Celesaphii), hold every right to the produced drawing, not the commissioner.
Therefore I am allowed to use the copyrighted artwork to;
Promote myself within any place or site.
Display anywhere to my liking.
Post wherever I want.
Any distribution/production rights
The commissioner is allowed to;
Use the copyrighted artwork for personal use only, unless agreed upon otherwise.
Print the art for personal use, and claim rights to their character(s) but not the drawing itself.
Use the art to promote themselves with proper credit given to myself.
If you break the copyright infringement in any way, every right you had to the drawing will be retracted.
The following is considered Copyright infringement:
Reproducing/using the copyrighted artwork commercially (putting the image on T-shirts to be sold, selling as a print, etc).
Taking credit for the creation of the artwork.
Removing any watermarks/signatures.
Altering the artwork in any way (with the exception of changing the image size) without my, Krista Pearson, consent.
If you post it anywhere you must give me credit as the artist.
I will post it to all my sites where you can reblog/favorite to gallery/ect...
If you wish to use your image for commercial uses you may purchase the commercial rights at 25% of the total image price.
Please notify me if you wish to purchase commercial rights.
15. Commercial Use
All commissions by default are quoted for non-commercial use. If you wish to commission something for commercial use you will be required to pay a flat 25% selling fee of original quoted price. With commercial rights you are allowed to make/produce merch, use the art in a book, on covers, as props, sell prints, etc. Credit is still required for usage of the artwork, even if altered or edited.
16. I shall not be held liable for any losses, damages or expenses incurred from the use of commissions.
17. Hours
I have a fairly busy life therefore I am not available all the time. I check my messages at least once a day and will respond when I can. Spamming inquiries will result in loss of slot, canceling of commission, and/or possibly banning. No refund depending on how far I am on your piece. I am slow, asking for updates daily is not acceptable.
My hours of business are as follows:
Monday and Wednesday 1-3pm 8-11pm
Tuesday, Thursday, and Friday 1-3pm 9-11pm
